Definitions
“Client” refers to an adult natural person to whom Crazover Virginie Sarah Madeleine Berthe provides supervisory and advisory services as part of coaching sessions.
“Online Client” refers to a Client who signs a Contract with Crazover Virginie Sarah Madeleine Berthe/on the Website https://virginiezerah.com/.
“Contract” refers to the contract between the Client and Crazover Virginie Sarah Madeleine Berthe that is governed by the registration form (in written form or on the Website), the general terms of sale between private individuals and Crazover Virginie Sarah Madeleine Berthe (as updated or modified). The stipulations of these general terms of sale prevail in the event of a conflict with any other contractual
document by and with Crazover Virginie Sarah Madeleine Berthe or the Client.
“Contributors” refer to the professionals ( professional coaches), employees, or independent contractors assigned by With Crazover Virginie Sarah Madeleine Berthe to provide the services within the scope of a Contract.
“With Crazover Virginie Sarah Madeleine Berthe” refers to the sole proprietorship With Crazover Virginie Sarah Madeleine Berthe, headquartered at 7, rue Delabordere 92200 Neuilly-sur-Seine, France.
“Website” refers to the website operated by Crazover Virginie Sarah Madeleine Berthe, whose address is

or any other address it may use in lieu.
Purpose of the Contract
The Contract stipulates the respective rights and obligations of Crazover Virginie Sarah Madeleine Berthe and her Clients for the sale and provision by Crazover Virginie Sarah Madeleine Berthe of the supervisory and advisory services within the scope of coaching sessions.
General Terms of Sale to Private Individuals
These General Terms of Sale set forth the rights and obligations of Crazover Virginie Sarah Madeleine Berthe and her Clients within the scope of the services provided by Crazover Virginie Sarah Madeleine Berthe. These General Terms of Sale apply to all contracts signed with the Clients (including on the Website).
These General Terms of Sale are intended solely for private individuals. Professionals may contact Crazover Virginie Sarah Madeleine Berthe directly to draw up a custom contract, if required.
Any service provided by Crazover Virginie Sarah Madeleine Berthe entails the Client's unconditional acceptance of these General Terms of Sale.
The Client acknowledges to have understood these General Terms of Sale, and expressly and unconditionally accepts them upon signing the registration form or registering on the Website.
Unless expressly agreed upon previously, any term conflicting with these General Terms of Sale cannot be invoked against Crazover Virginie Madeleine Berthe regardless of when said terms came to her attention.
Crazover Virginie Sarah Madeleine Berthe regularly updates the General Terms of Sale to ensure they best adhere to the needs of Clients and the regulations in force. The General Terms of Sale applicable to the Client Contract are available on the Website. They shall be considered accepted by the Client within two (2) weeks if the client does not indicate otherwise.
The Client is permitted to copy the General Terms of Sale posted on the Website.
Services
Crazover Virginie Sarah Madeleine Berthe offers her Clients supervisory and advisory services within the scope of coaching sessions. The services of Crazover Virginie Sarah Madeleine Berthe are in no way intended to be construed as medical advice, and are never a substitute for medical treatment.
All sessions include the services of a skilled professional Contributor qualified in their specialty.
Contributors lead sessions in accordance with industry standards, and provide the necessary care, professionalism, availability, and diligence.
Structure and Schedule
The Contributor assigned by Crazover Virginie Sarah Madeleine Berthe is the Client’s point of contact for scheduling and structuring their sessions.
Appointments for sessions are made with the Contributor directly.
The Contributor must approve the dates and times of the sessions beforehand.
The attendees of group sessions must have common goals.
Lateness, absence, cancellation, and suspension
Clients are required to respect the appointments and times agreed upon beforehand. No sessions can be canceled once reserved, and payment will be due. However, sessions may be rescheduled within the week depending on the Contributor’s availability, and only if the Client postpones the session
at least 24 hours in advance.
Any late arrivals on the Client's part shall automatically be deducted from the session time.
Just Coaching may cancel a session up to six (6) hours before it begins. Nonetheless, Crazover Virginie Sarah Madeleine Berthe reserves the right to cancel an on-site session up to one (1) hour before the session begins due to weather conditions or a case of force majeure that makes it impossible to attend. In the event of a cancellation, the Client shall receive a call (or a text if there is no answer), and the session will be postponed to a later date.
Crazover Virginie Sarah Madeleine Berthe cannot be held responsible for delays in providing services due to cases of force majeure such as weather disasters, transportation-related accidents while a Contributor is en route, or any other force majeure event. In these cases, the Client will be notified as soon as possible, and the session will be postponed to a later date.
House rules
Without prejudice to the following, Crazover Virginie Sarah Madeleine Berthe and the Contributor may disallow or even terminate the Contract, at any time and with no compensation whatsoever, with any Client who acts or behaves in a manner that is contrary to good moral standards, or who is egregiously disruptive, unacceptable, or dangerous to themselves or others.
Duration and Continuance of the Contract
The Contract ends on the first of two dates, either (i) the date when all the sessions have been completed, or (ii) the date when the period for completing the sessions has expired, even if not all of the sessions have been provided due to any action or failure to act by the Client.
The period for conducting the sessions is 12 months from the reservation date (date when the invoice is issued), unless Crazover Virginie Sarah Madeleine Berthe grants a special courtesy in the event of force majeure (medical reason or accident).
If the Contracted services are only partially delivered, the entire price remains owed to Crazover Virginie Sarah Madeleine Berthe unless this partial delivery is due to Crazover Virginie Sarah Madeleine Berthe's actions or failure to act.
The Client is not permitted to suspend or terminate the Contract, unless in cases of force majeure, medical reasons, or accidents. In the event the Contract is suspended, the Client must provide proof before Crazover Virginie Sarah Madeleine Berthe agrees to reimburse the fees paid for sessions that the Client is unable to attend.
The Client cannot transfer the Contract or the sessions without prior consent from Crazover Virginie Sarah Madeleine Berthe.
Prices and Payment Methods
The price set by Crazover Virginie Sarah Madeleine Berthe is guaranteed for the term of the Contract. Crazover Virginie Sarah Madeleine Berthe reserves the right to update the price of the care services when signing a new contract.
The prices are displayed in euros (€) and include all taxes.
The prices include preparation time for technical sessions and follow-up care.
The number of sessions and the total price shall depend on the number of sessions the Client chooses, and may change according to the Client’s varying needs throughout the Contract. In such cases, Crazover Virginie Sarah Madeleine Berthe and the Client shall be required to sign a new contract.
Liabilities
Crazover Virginie Sarah Madeleine Berthe can be held liable only if a causal link can be demonstrated between any gross negligence committed by Crazover Virginie Sarah Madeleine Berthe while executing the Contract, and damages suffered by the Client. Specifically, Just Coaching cannot be held liable in the event of (i) an accident caused by a Client’s failure to follow a Contributor's instructions; (ii) an accident that occurs while not in session or by not following a Contributor's instructions; (iii) any actions or failure to act by a Contributor who is not employed by Crazover Virginie Sarah Madeleine Berthe; (iv) the Client not complying with the commitments and guarantees provided for in the Contract; and/or (iv) force majeure. Crazover Virginie Sarah Madeleine Berthe shall not be required to pay any compensation for indirect damages (including, but not limited to: loss of income, loss of opportunity, lost earnings, and any financial or non-pecuniary damage).
Crazover Virginie Sarah Madeleine Berthe is not liable in the event of retaining sole responsibility for the commitments and guarantees made in the Contract.
The Client will be liable for any harm incurred, material damage, or bodily injury caused by any voluntary or involuntary act that he or she commits.
The Client also agrees to guarantee and cover all legal judgments and fees that may be incurred or charged to Crazover Virginie Sarah Madeleine Berthe resulting from any fault, neglect, or other act committed by the Client.
Online Sales
The purpose of this section of the General Terms of Sale is to stipulate the terms and methods governing the sale of the services provided by Crazover Virginie Sarah Madeleine Berthe on the Website exclusively; this section does not apply to Contracts signed by other means.
The Website is solely intended for private individuals. Professionals must contact Crazover Virginie Sarah Madeleine Berthe directly. The online offers posted on the Website are reserved for Clients residing in metropolitan France.
Web Clients acknowledge that the ordering process on the website constitutes a Contract between the Web Client and Crazover Virginie Sarah Madeleine Berthe.
The Web Client must carefully read the General Terms of Sale and accept them prior to any order being approved.
Before placing an order, the Web Client must read the description and features of the services they wish to purchase. Photographs and illustrations are not legally binding documents.
A Web Client's acceptance of the service is approved when their order is confirmed via a double-click process.
By clicking on the “Select” button first to place the order, and then the “Pay” button second to confirm the order, the Web Client thereby acknowledges that they have read, understood, and unconditionally accept the General Terms of Sale. The General Terms of Sale are accessible via a link on the bottom of every page and must be viewed before clicking on the second button “Select” in order to submit an order. Crazover Virginie Sarah Madeleine Berthe also requests that Web Clients read and accept the General Terms of Sale for each new order.
The prices displayed on the Website apply to all purchases made on the Website.
The prices are displayed in euros (€) and include all taxes.
By clicking on “Appointment,” on the following page, the Web Client must also provide all the information required to perform the services as well as their contact details. Purchases on the website must include any information needed to correctly process the order.
Crazover Virginie Sarah Madeleine Berthe accepts payment by debit card, credit cards such as Visa and MasterCard, and PayPal.
The Website is protected by a secure payment system. Crazover Virginie Sarah Madeleine Berthe uses the STRIPE payment system (Stripe specializes in secure online payments and guarantees the complete confidentiality of the Web Client’s banking details).
The total price is displayed on the order summary page.
Before confirming the order, the Client has the option to verify the details of the Order and total price, and to return to previous pages to correct any errors or change the order, in accordance with Article 1369-5 of the French Civil Code. Confirming an order implies acceptance of the General Terms of Sale and the creation of a contract. When making a purchase on the Website, the Client expressly acknowledges their obligation to pay.
Payment is received by Crazover Virginie Sarah Madeleine Berthe when the order is made.
The Web Client receives a confirmation email for the purchase. The purchase is not completely confirmed until payment is approved, and does not commit Crazover Virginie Sarah Madeleine Berthe until the order confirmation email has been received (confirmation is only sent for online purchases). Consequently, the Web Client must check their email inbox. Any services purchased that are part of the same order but do not appear in the confirmation email are not included in the Contract.
In the absence of any indication or prior agreement as to when the services will be rendered, Crazover Virginie Sarah Madeleine Berthe must provide or have the services provided without undue delay within a maximum of thirty (30) days from the signing of the contract.
The Web Client has fourteen (14) calendar days from the day the Contract is signed on the Website to cancel. The Web Client must inform Crazover Virginie Sarah Madeleine Berthe by any means of their clear and unequivocal desire to cancel. The Web Client may use the cancellation form provided upon request by Crazover Virginie Sarah Madeleine Berthe and must ensure that proof is kept in the event of a dispute.
In the event of a cancellation, Crazover Virginie Sarah Madeleine Berthe shall refund the Web Client in full for the amounts paid without undue delay within a maximum of fourteen (14) days after the date she is informed of the Web Client’s desire to cancel. Refunds are made by the same payment method used at purchase. No fees shall be paid as a result of this refund.
The Web Client will have waived their right to cancel if the service is rendered within the cancellation period of fourteen (14) calendar days.
Communications, purchase orders, and invoices are saved using a reliable and durable medium so that a reliable and durable copy can be recreated. Communications, purchase orders and invoices may be presented as proof of Contract.
Personal Data
When registering, the Client is obliged to provide any personal data needed to process the registration and provide the service. This data may also be used for marketing communication purposes by Crazover Virginie Sarah Madeleine Berthe. Crazover Virginie Sarah Madeleine Berthe will store the personal data for up to two (2) years from the end of the Contract. The data recipients are Crazover Virginie Sarah Madeleine Berthe and the professionals assigned by Crazover Virginie Sarah Madeleine Berthe to provide the services within the scope of a Contract.
In accordance with the French Data Protection Act of January 6, 1978, as modified in 2004, the Client has the right to access and rectify their personal data.
Any Client may exercise their right to access, object to and rectify by sending a letter to Auto-entrepreneur Crazover Virginie Sarah Madeleine Berthe – 7, rue Delabordere 92200 Neuilly-sur-Seine or by email at

For legitimate reasons, the Client may object to the processing of their personal data. The Client may also object to the use of their personal data for marketing purposes by sending an email using the link provided in all emails sent.
Clients who object to the use of their personal data for marketing purposes will stop receiving promotional offers from virginiezerah@virginiezerah.com, affiliates or partners.
Intellectual Property
All the visual and audio elements from virginiezerah@virginiezerah.com and on the Website, including the underlying technology used, are protected by copyright, trademark, and patent law and, more generally, all intellectual property rights. These elements are the exclusive property of virginiezerah@virginiezerah.com or the rightsholders. None of the elements on the Website, either in whole or in part, can be modified, reproduced, copied, duplicated, sold, resold, transferred, published, shared, distributed, circulated, represented, stored, used, leased or exploited in any other manner, whether for free or at a cost, regardless of the means and/or media employed, whether currently known or not known, without the prior written authorization of virginiezerah@virginiezerah.com.

Applicable Law and Competent Jurisdiction
Any litigation relating to the interpretation and execution of the Contract is subject to French law.
Disputes that may arise regarding the validity, interpretation, fulfillment or nonfulfillment, interruption, or termination of the Contract will be subject to mediation in accordance with the CMAP (Paris Mediation and Arbitration Center) regulations on mediation at the Paris Ile-de-France Chamber of Commerce and Industry, which the Parties acknowledge and declare to abide by. Should mediation fail, disputes shall be brought before the competent French jurisdictions.
Other Clauses
Any modifications to the laws and regulations in force, or any rulings issued by a competent court that invalidates one or more clauses in the General Terms of Sale shall not alter the validity of all the General Terms of Sale, whose other stipulations will remain fully binding and in force. Such modifications or rulings do not authorize the Client in any way to disregard the General Terms of Sale.
The fact that Auto-entrepreneur Crazover Virginie Sarah Madeleine Berthe may decide not to exercise any of the clauses in the Contract at any given time cannot be interpreted as relinquishing the right to exercise them at a later time.
The General Terms of Sale can be viewed on the Website and are subject to change at any time at the discretion of Auto-entrepreneur Crazover Virginie Sarah Madeleine Berthe, without any warning other than being posted online. Only the
latest version will apply.
